10.1

Additional Restrictions to the City's Mask By-law

Councillor Porter will present the following motion:

 

WHEREAS COVID-19 is a disease which is present in the City of
St. Catharines and is readily communicable from person to person and carries a risk of serious complications such as pneumonia or respiratory failure, and may result in death; and

 

WHEREAS the spread of COVID-19 has been declared a pandemic by the World Health Organization on March 11, 2020; and

 

WHEREAS subsection 8(1) of the Act provides the City with broad authority to provide any service or thing the City considers necessary or desirable for the public; and Whereas the City has the authority to pass by-laws respecting matters related to the economic, social and environmental well-being of the City, and the health, safety and
well-being of persons under paragraphs 5 and 6 of subsection 8(2) of the Act; and

 

WHEREAS physical distancing is difficult to maintain in enclosed common areas of apartment buildings and condominium buildings;

 

THEREFORE BE IT RESOLVED that Part Section 3(g) of the City of
St. Catharines Bylaw 2020-97 be amended with the following revision:

         common areas of hotels, motels, and other short-term accommodations, such as lobbies, elevators, meeting rooms, rest rooms, laundry rooms, gyms, and kitchens or other common use facilities, including the common areas of residential apartment buildings and condominiums; and

 

BE IT FURTHER RESOLVED that owners of apartment buildings and condominium corporations responsible for condominium buildings with enclosed common areas shall adopt a policy to ensure that persons wear a mask or face covering as it is a necessary, recognized, practicable and effective method to limit the spread of COVID-19 and helping protect the health, safety and well-being of the residents of the City of St. Catharines.

 

 

 

 

10.2

Development Approval Requirements for Landfills - (Bill 197)

Councillor Dodge will present the following motion:

 

WHEREAS Schedule 6 of Bill 197, COVID-19 Economic Recovery Act, 2020 considers amendments to the Environmental Assessment Act relating to municipal autonomy and the principle that municipalities can veto a development outside their municipal boundary in an adjacent municipality; and

 

WHEREAS Bill 197 empowers multiple municipalities to ‘veto’ development of a landfilling site within a 3.5 km zone inside the boundary of an adjacent municipality; and

 

WHEREAS Bill 197 establishes a dangerous precedent that could be expanded to other types of development; and

 

WHEREAS Bill 197 compromises municipal autonomy and the authority of municipal councils to make informed decisions in the best interest of their communities and municipal taxpayers; and

 

WHEREAS amendments in Schedule 6 could cause conflict in the effective management of landfill sites, put significant pressure on existing landfill capacity, and threaten the economic activity associated with these sites;

 

THEREFORE BE IT RESOLVED That the City of St. Catharines calls upon the Government of Ontario (Ministry of the Environment, Conservation and Parks (MOECP) to amend Bill 197, COVID-19 Economic Recovery Act, 2020, to eliminate the development approval requirement provisions from adjacent municipalities and that the ‘host’ municipality be empowered to render final approval for landfills within their jurisdiction; and

 

BE IT FURTHER RESOLVED that a copy of this motion be forwarded to Premier Doug Ford, Jeff Yurek the Minister of Environment, Conservation and Parks, Steve Clark the Minister of Municipal Affairs and Housing, local MPP's., the Association of Ontario Municipalities (AMO) and Ontario’s Big City Mayors (formerly Large Urban Mayors Caucus of Ontario-LUMCO)

 


BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded to all Ontario municipalities with a request for supporting motions to be passed by respective Councils and copies of the supporting motion be forwarded to Premier Doug Ford, Jeff Yurek the Minister of Environment, Conservation and Parks, Steve Clark the Minister of Municipal Affairs and Housing, the local MPP, the Association of Ontario Municipalities (AMO).

Additional Council Meeting - Transportation Master Plan Training

Councillor Littleton will present the following motion:

 

That Council approve an additional meeting for the 2020 Council meeting schedule; and

 

That the meeting be held for the purpose of training regarding the City’s draft Transportation Master Plan; and

 

That the meeting be held on Tuesday, November 24, 2020 commencing at 6 p.m.; and

 

That the City Clerk advise the members of Council by November 17, 2020 of the details of the meeting, including time and location and if the meeting is to be held in person; and

 

That the City Clerk be directed to make the necessary notifications.
